SmartChat Acceptable Use Policy

This policy forms part of the Terms of Service.

SmartChat is built on trust. These rules keep the platform healthy and keep your WhatsApp access safe.

Consent is your responsibility

You are responsible for getting valid opt-in consent from every person you message through SmartChat, and for keeping proof of that consent. You must honour every opt-out request without delay. You may not send unsolicited or bulk marketing messages. You will comply with POPIA, the Consumer Protection Act, and the WhatsApp Business Messaging Policy at all times.

What you will not do

  • No cold spam or unsolicited bulk messaging.
  • No content that is illegal, hateful, threatening, misleading, or deceptive.
  • No abuse of the WhatsApp Business API or any platform we integrate with.
  • No attempts to bypass, reverse engineer, or overload our systems.
  • No pushing of special personal information, such as health data, through the bot without a proper legal basis.

What the bot must not be used to do

You may not use SmartChat to make promises, prices, or commitments on your behalf that you cannot honour. You are responsible for what your bot says to your customers.

If we see a problem

For minor issues we reach out first. Where your conduct threatens our platform, our WhatsApp access, or other users, we may suspend your account immediately. You indemnify Ruka (Pty) Ltd against any claim, penalty, or platform action arising from your messaging.
