SmartChat POPIA Statement

SmartChat is built to meet South Africa's Protection of Personal Information Act.

Our foundation

• Data hosted in the Google Cloud Johannesburg region.
• Encryption in transit and at rest.
• Role-based access control and audit logs.

Your role and ours

When you use SmartChat to communicate with your customers, you are the Responsible Party and we are the Operator. Our Data Processing Agreement forms part of your Terms and sets out how we process on your behalf. It is not optional and not on request. You accept it when you sign up.

Sub-processors

We use Google Cloud for hosting and Meta for WhatsApp messaging, along with any integrations you connect. Messages over WhatsApp are also processed by Meta on its own infrastructure.

Breaches

If a security compromise affects your data, we notify you without undue delay, give you the detail you need, and help you notify the Information Regulator through the eServices portal and any affected people, within the timelines POPIA requires.
